Married duo Kanye West and Kim Kardashian‘s past lawsuit against the co-founder of YouTube over leaking their marriage proposal event a couple years ago is reportedly moving forward.

According to reports, a California appeals court has green lighted the 2013 case against Chad Hurley.

The 2nd District Court of Appeal in Los Angeles upheld the ruling Wednesday, saying West and Kardashian have shown a likelihood they could win a case on claims of breach of contract, fraud and unjust enrichment. Hurley argued that a confidentiality agreement he signed was not binding on MixBit, but the court said that argument lacked merit. (Page Six)

The publicized case was previously appealed in California.

The original lawsuit dates back to 2013 when the couple accused Hurley of leaking their proposal video on his site, MixBit. Hurley’s lawyers initially appealed the lawsuit last year. Hurley originally posted the video on the site before it aired on “Keeping Up With the Kardashians,” which is how the couple wanted it to be released. (Complex)

Aside from the legal situation, the rap star treated invited guests to a 20-minute performance at the Lincoln Center in New York City earlier this week.
