Rapper DaBaby has been charged with felony battery stemming from a Dec. 2020 incident where the rapper allegedly punched a rental-property owner in Los Angeles.

This comes after the rapper’s lawyers came to his defense when a video surfaced of him appearing to be the aggressor in a fatal Walmart shooting.

The Charges Keep Piling Up

In December 2020, DaBaby, real name Jonathan Kirk, allegedly punched a property owner in Los Angeles, resulting in a felony battery charge.

In February 2021, two months after the incident was reported to the police, Gary Pagar filed a lawsuit against DaBaby and his associates. The lawsuit claimed the rapper punched him after Pagar complained that he had violated the terms of their lease agreement. At the time of the incident, DaBaby was reportedly shooting a music video with over 40 people in the home. However, he had agreed to not allow more than nine people in the house due to COVID-19 protocols.

“They signed the lease, and personally assured Mr. Pagar they’d adhere to it; they promised there’d be no crowds, no parties, and no filming. Those were bald-faced lies,” the lawsuit read.

The lawsuit continued on to say, “In fact, the purpose of defendants’ trip to Los Angeles was to gather 40 people and a commercial film crew at Mr. Pagar’s house to film a music video… When Mr. Pagar asked them to stop, they beat and battered him, stole his phone by force so he couldn’t call the police, and threatened him.  Then they vandalized his house and left, after stealing various valuable items. Defendants’ behavior was utterly despicable.”

The criminal case was still pending 16 months after the alleged assault. Los Angeles County court documents confirm that the “Suge” rapper will be facing felony battery charges stemming from the incident. Pagar said his tooth was knocked out, as well as other injuries. 

One of DaBaby’s associates, Thankgod Awute, will be facing a felony charge of theft using force. WCNC Charlotte also confirmed arrest warrants were issued for both Kirk and Awute for “willful and unlawful use of force and violence”.

When speaking to The Rolling Stone about his lawsuit against DaBaby, Pagar said, “There are people who believe that the rules don’t apply to them”. “Whatever the rules are, whether it’s the law, that they can do what they want with impunity, and there are no consequences. That’s who [Kirk] was,” he added. 

Pagar also added that he wanted to “have this man pay for his behavior, and hopefully teach him a lesson that the rules actually do apply to him.”

According to the Los Angeles County Court database, Kirk will have a preliminary hearing in connection to the charges on June 1 at the Clara Shortridge Foltz Criminal Justice Center.

DaBaby’s legal team has come out blazing after new footage was obtained of the 2018 Walmart shooting.  The North Carolina rapper invoked the Stand Your Ground law, made famous by Trayvon Martin’s killer, George Zimmerman.

His legal team came out in his defense after a video was released this past Sunday. In the video, it appears the “Suge” rapper was the aggressor in a fatal fight in a Walmart store.

The North Carolina native’s defense team, which consists of Drew Findling and Marissa Goldberg, issued a statement saying the investigators concluded that he was justified in the shooting after seeing the clip in 2018.
