G-Unit head 50 Cent is going to have to find his best suit and tie as reports claim he is headed to trial in a publicized sex tape case with rap rival Rick Ross‘ ex-girlfriend Lastonia Leviston.

According to reports, a federal judge would not allow 50 to avoid his state trial despite filing for bankruptcy for his SMS Promotions company Thursday (May 28).

Judge Katherine Failla separated the two cases at the request of a young Florida mother who accuses the rapper, real name Curtis Jackson, of humiliating her and invading her privacy by posting a video on the Internet of her having sex with a boyfriend. Lawyers were supposed to start picking a jury Tuesday in state court, but that was postponed after 50 Cent without warning made the bankruptcy filing for SMS Promotions. (NY Daily News)

This week, Rick Ross’ lawyer Xavier Donaldson addressed 50 naming him in a lawsuit.

“The recent lawsuit filed by Curtis Jackson against Mr. William Roberts is clearly another attempt to draw attention to his descending entertainment career and one of several desperate, last minute attempts he’s made to avoid and deflect legal and financial responsibility for his own actions related to the pending New York City civil trial in which he’s a defendant. The New York City lawsuit was filed against Curtis Jackson five years ago. Mr. Roberts was neither named as a defendant nor legally joined by Mr. Jackson in that suit. If and/or when Mr. Jackson properly serves Mr. Roberts, we will aggressively address and defend against these frivolous and futile claims.” (HHW)

Buzz about the lawsuit’s existence bubbled online earlier this month.

50 has filed a lawsuit — obtained by TMZ — in which he’s trying to deflect blame from himself for the video which now has millions of views. Lastonia Leviston has sued 50 claiming she was so distraught after 50 posted the video she contemplated suicide. But now 50 says Ross is actually the one who created the problem because he or one of his lackeys was first to post it … 50 just linked to it. 50 points to an interview Ross did with a radio station the day before the video was posted in which he said he was going to put the sex tape online. Back in 2010, 50 said he was confident in the faults on the plaintiff’s side.

“That wasn’t me, that was Pimpin’ Curly….a person tries to say, you’ve done a mental harm to them. Then they might want to consider the recordings of Rick Ross saying that she’s an actual call girl. Or the pamphlets that I’m showing in the tape, that’s saying that she’s available. So how distraught is she that a tape went out? They think I bought the tape, I didn’t even buy it.” (Miss Info)
