Prior to the ruling, the victim’s shooter claimed he acted in self defense.

A judge added four years to Gaines’ sentence for a conviction on a charge of vehicular eluding for leading police on a chase, two years for possession of a gun by a previous offender and four years for a 2007 marijuana possession conviction. (KDVR News)

The fatal shooting took place following an E-40 concert in April 2009.

Terry Gaines Jr., 22, was arrested on suspicion of first-degree murder. Colorado Springs police officers were helping with crowd control at Mr. Biggs, 5825 Mark Dabling Blvd. in northwest Colorado Springs, as people poured into the parking lot after a show by E-40, a Bay Area rapper. Shortly after midnight police reported hearing gun shots, according to a news release. They found the victim shot and sitting in a silver sedan. Some officers tried to resuscitate the man until emergency crews arrived. Others began stopping vehicles on Mark Dabling. (Gazette)

After violence erupted at a prior E-40 concert, the rap veteran issued a statement to SOHH speaking on his disassociation from violence.

“Neither E-40 nor anyone traveling with him was in the venue at the time — E-40 had concluded his performance and been back in the hotel room,” 40’s management wrote in a statement. “He encountered nothing but love and gave nothing but love back. E-40 had a crowd pleasing and peaceful show…. While he certainly regrets that this incident took place, E-40 and camp are unable to control the poor and tragic choices that other adults choose to make.” (SOHH)
