Baby Sued For Concert No-Shows, Accused Of Owing Promoter Over $275K

Cash Money Records’ co-founder BryanBirdmanWilliams has been sued for accusations of fraud, breach of contract plus money had and received stemming from canceled performances beginning last year.

According to TMZ, promoter Jose Fernandez has filed a lawsuit against the rapper and his associates after paying over a quarter of a million dollars for a November 2007 concert in New Orleans that never took place that was then re-scheduled twice, once in January and the next in March but were each no-shows.
“As a direct and proximate result of the the breach of contract, Plaintiffs have been damaged in a sum in excess of $275,000,” the suit reads “Plaintiffs are unaware of the exact amount of their damages, but will amend this Complaint to state the true amount to conform to proof at time of trial.”
Fernandez is also claiming Birdman’s promise of bringing in additional performers like Lil’ Wayne was completely fabricated.
“At the time the Defendants, and each of them, promised to promote and produce a concert with BIRDMAN and his FRIENDS, they had no intention of ever doing the concert. The promises were made to induce Plaintiffs to advance funds in the sum of $275,000 to Defendants, and each of them,” it reads. “At a direct and proximate result of Defendants’ false promise to produce and promote a concert, Plaintiffs have been damaged in a sum in excess of $275,000.”
In addition, the lawsuit files for damages of money had and received claiming no payment was made to Fernandez since giving the advance to Birdman. He is currently seeking rewards for special, general and punitive damages plus attorney fees.
